Agreement to Terms: By accessing or using Lake Martin Delivery’s services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

1. Acceptance of Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you and Lake Martin Delivery (“Company,” “we,” “us,” or “our”) regarding your use of our grocery delivery and concierge services, website, and mobile applications (collectively, the “Services”).

By creating an account, placing an order, or using any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Refund Policy.

2. Service Description

2.1 Overview

Lake Martin Delivery provides grocery and retail delivery services to the Lake Martin, Alabama region. Our services include:

  • Subscription-based grocery delivery with multiple plan tiers
  • Same-day delivery options
  • In-store pricing with no markups on products
  • White-glove concierge delivery service
  • Property management services for vacation rentals
  • Guest ordering services

2.2 Service Area

Our services are currently available in the Lake Martin area, including but not limited to:

  • StillWaters
  • Dadeville
  • Camp Hill
  • Surrounding lake communities

We reserve the right to modify our service area at any time. Delivery to areas outside our standard service zone may be subject to additional fees or may not be available.

3. Account Registration and Eligibility

3.1 Age Requirement

You must be at least 18 years old to create an account and use our Services. By creating an account, you represent and warrant that you are at least 18 years of age.

3.2 Account Information

When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities under your account

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Providing false or misleading information
  • Abusive behavior toward our staff or delivery personnel
  • Non-payment or chargebacks

4. Subscription Plans

4.1 Available Plans

Note: Monthly subscription fees are separate from service fees. Service fees are charged per delivery based on your order size.

4.2 Billing and Renewal

  • Subscription fees are billed monthly on the date you subscribe
  • Subscriptions automatically renew each month unless canceled
  • We will charge the payment method on file at the beginning of each billing cycle
  • Price changes will be communicated at least 30 days in advance
  • You are responsible for maintaining valid payment information

4.3 Service Fees

Important: In addition to your monthly subscription fee, a service fee is charged per delivery based on your order size. This fee covers personal shopping, quality checking, packing, delivery, and white-glove service.

Example: If your order total is $75.00, you will pay $75.00 (groceries) + $3.00 (service fee) = $78.00 total, plus any tip you choose to add.

What Service Fees Cover:

  • Personal shopping of your order at the store
  • Quality checking and selection of the freshest products
  • Professional packing and handling
  • Delivery to your door
  • White-glove concierge service
  • Payment processing costs

Service Fee Policies:

  • Service fees are calculated based on your order subtotal (before tip)
  • Service fees are charged per delivery, not monthly
  • Service fees are charged at the time your order is delivered
  • Service fees are non-refundable once delivery is completed successfully
  • Service fees may be refunded if you cancel more than 2 hours before your scheduled delivery
  • Service fees are waived for weather-related cancellations initiated by Lake Martin Delivery
  • All subscription plans (Starter, Standard, Premium, and Concierge) are subject to the same tiered service fee structure

5. Orders and Pricing

5.1 Placing Orders

  • Orders can be placed through our website or mobile app
  • You must have an active subscription to place orders
  • Orders are subject to product availability
  • We reserve the right to refuse or cancel orders in our discretion

5.2 Product Pricing

  • In-Store Pricing: We charge the same price you would pay in-store (no markups)
  • Prices are subject to change based on retail partner pricing
  • Sale prices and promotions are honored when available
  • Price estimates are provided but may vary based on actual in-store prices at time of shopping

5.3 Substitutions

  • If a requested item is unavailable, we will attempt to contact you for a substitution
  • If we cannot reach you, we will use our best judgment to select a comparable substitute
  • You may refuse substitutions upon delivery
  • You will only be charged for items you accept

6. Delivery Terms

6.1 Delivery Schedule

  • Deliveries are available 7 days per week, 9:00 AM – 8:00 PM
  • Same-day delivery available for orders placed before 5:00 PM
  • Specific delivery time windows will be confirmed when you place your order
  • We will notify you when your delivery is on the way

6.2 Delivery Delays and Cancellations

We strive for on-time delivery but delays may occur due to:

  • Weather conditions (storms, flooding, ice)
  • Traffic or road closures
  • High order volume
  • Unforeseen circumstances

We will notify you of significant delays. In cases of extreme circumstances, we may need to cancel or reschedule deliveries.

7. Alcohol Delivery

Important Notice: Alcohol delivery is not currently available through Lake Martin Delivery.

At this time, we do not have the necessary licenses to deliver alcoholic beverages. We are exploring the possibility of offering alcohol delivery in the future, subject to obtaining proper licensing and regulatory approval.

8. Property Management Services

8.1 Property Manager Accounts

Property managers can create accounts to:

  • Manage multiple properties
  • Set up pre-arrival stocking services
  • Enable guest ordering capabilities
  • Track inventory and automatic restocking

8.2 Guest Orders

  • Property managers can authorize guest ordering for their properties
  • Guests can place orders via QR codes or property-specific links
  • Property managers are responsible for all charges related to guest orders
  • Property managers may choose to pass costs through to guests

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

LAKE MARTIN DELIVERY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Services
  • Unauthorized access to your account or data
  • Product quality, availability, or pricing issues
  • Delivery delays or cancellations
  • Any conduct or content of third parties

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE PAST 12 MONTHS.

10. Dispute Resolution

10.1 Informal Resolution

10.2 Governing Law

These Terms are governed by the laws of the State of Alabama, without regard to conflict of law principles.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on our website
  • Updating the “Last Updated” date
  • Sending email notification to active subscribers

Your continued use of the Services after changes constitutes acceptance of the modified Terms.
